South Carolina recognizes real estate transactions as the practice of law and therefore you will need an attorney to handle a real estate closing. Many states are not what are referred to as “Attorney Closing States” but SC is not one of them. A real estate attorney reviews the purchase agreement, checks the title for liens or ownership issues, makes sure the deed is prepared and recorded correctly, and represents your interests at closing.
An agent helps you find a property, negotiate prices, and navigate the market. South Carolina uses a form real estate contract that agents are authorized to complete and submit to buyers and sellers; however, agents aren't licensed to give legal advice. An attorney reviews contracts, resolves title problems, handles disputes, and protects you legally if something goes wrong. Many buyers and sellers use both: the agent for the transaction logistics, the attorney for the legal protection. If you are engaging in a “for sale by owner” transaction without the use of an agent, you will need an attorney to draft the agreement.
Title insurance protects you (and your lender) against financial loss if a problem with the property's ownership history surfaces after closing, for example, an undisclosed lien, a forged signature in a past deed, or an heir who claims an ownership interest. Most lenders require a lender's title policy; a separate owner's policy is optional but recommended, since it protects your equity, not just the bank's loan.
At closing, the buyer and seller (or their representatives) sign the final documents, funds are transferred, and ownership officially passes to the buyer. The attorney's role is to review the closing disclosure, confirm all conditions of the contract have been met, resolve any last-minute title issues, and make sure the deed is properly executed and recorded. Closings typically take 30-60 minutes for a straightforward residential sale, though the overall path from contract to closing usually takes 30-45 days.
It depends on the contract terms. Most residential purchase agreements include contingencies such as: financing, inspection, appraisal. These contingencies will at times allow a buyer withdraw and recover their deposit if a specific condition isn't met within a set timeframe. Backing out without a valid contingency can expose you to loss of your earnest money deposit or even a breach-of-contract lawsuit. Always have an attorney review the specific contingency language before signing or trying to cancel.
A title search examines public property records to confirm the seller actually has the legal right to sell, and to identify anything that could cloud ownership such as: unpaid property taxes, mortgages that were never released, contractor's liens, boundary disputes, or missing heirs from a prior owner's estate. Clearing these issues before closing prevents them from becoming your problem after you own the property.
A warranty deed guarantees that the seller holds clear title and will defend against any future claims against it. This is the standard deed used in most home sales. A quitclaim deed transfers whatever interest the seller has, with no guarantees about the title's condition; it's commonly used between family members, in divorce settlements, or to clear up a minor title defect, not typically for arm's-length home sales.
Don't take action (like building a fence or removing a structure) until the issue is resolved. Start with a licensed survey to establish the legal boundary, then have an attorney review it against the deed and any easements of record. Many disputes can be resolved through negotiation or a boundary line agreement recorded with the county; litigation is typically a last resort.
Not usually. Most disputes (over contract terms, disclosure failures, or contractor issues) are resolved through negotiation, mediation, or arbitration, which are faster and less costly than a lawsuit. Litigation becomes necessary when a resolution can't be reached or when the amount at stake and complexity justify it. An attorney can advise which path fits your situation.
Fees vary depending the complexity of the transaction. Flat-fee closing representation is common for standard residential deals, while hourly billing is typical for commercial closings, complex land use matters and for disputes or complications.
